According to reports that reached a doctor, this is a personal injury claim as well as personal damages claim by four private individuals against the state of New York in 1955. Hyman Portnoy, Theodore Galperin, Irving Mittenberg and Sheldon Ludmerer were the people involved in a road car accident on the night of June 26, 1955 going to Monticello on Route 42. All four men were riding a 1949 Oldsmobile Sedan which was being driven by Ludmerer. According to reports, the Oldsmobile skidded to the accident point somewhere about one half mile near Kiamesha. According to Ludmerer, the car swerved, skidded and hit a stanchion before it went off the road and finally stopping at a ditch ahead.

The expert also got the report that according to the testimony of Portnoy, immediately before the car accident happened, he felt the car passed by some pebbles and stones some 2 to 3 feet along Route 42. He also further testified that about a week or two before the accident, he had been walking on the same route and saw that there were sand and dirt thick enough to cover the pavement but failed to describe the exact thickness of the dirt.

On the other hand, when Ludmerer testified, he said that he was very familiar with the road that they were travelling that night. He said he did not remember seeing any dirt or pebbles on the road that night. He also said that we was not really paying attention on the actual road. At the hospital he casually mentioned to the State Trooper that he thought he was probably going too fast. But this part was not mentioned on his testimony on the court.

Vehicular accidents are quite common at present although roadways are always maintained and kept at top condition to prevent the occurrences of car accidents. However, most of the time, when met with a mishap, a driver will immediately point the blame at someone without considering his or her actions that might have contributed to it. Some people pin the blame on drivers in front or on the other lane and there are also times when some blame road signs and conditions for their crashes. Although there are some legitimate claims wherein people got compensated for claims against missing road signs and warnings for hazards, some fail to prove their claims against the State for running into road accidents. Let us take a look how this may happen in one of the cases that was examined by one of our top experts.

On a damp and cloudy morning in November 1952, a couple was driving to a meeting when the husband, Howard W. Naulty pulled over the side of the road and let his wife, Melba Naulty, drive the rest of the way. The husband then concentrated on making his notes for the said meeting and they were pleasantly driving at a speed of 40mph on a steep and winding road when the vehicle veered to the right and wheels were caught on a depressed shoulder. In an attempt to correct the car’s position, Melba Naulty tried to regain the car’s composure, which only made it swerve to the left and back to the right side of the road until the couple found themselves once and for all out of the road across a field into a small furrow and further skidded and rolled over until it came to a stop.

Witnesses from a nearby house immediately called for help and an ambulance was dispatched to take the couple to a nearby hospital. In the hospital, Melba Naulty was examined by a doctor and was found to have sustained a big bump in the head, some possibly fractured rib, back pain, lower rib tenderness and abdominal pain. She was put on a cast for several months to correct the fractures on her rib and on the vertebral column. Howard Naulty, however was only treated for minor injuries but he also suffered headaches and back pain and incurred minimum hospital expenses.

Mystery car accidents are frustrating for the police, particularly when it involves children, as in this case, commented the police. The 15-year old was ejected from the car she was riding in when it veered off the road and went into a roll over. She was dead on impact with the ground.

The vehicle in which she was riding had been headed to the nearest town and was being driven by an 18-year old young man, who didn’t have that much experience driving. Ambulance crews took him to the hospital, where he was treated for minor injuries and discharged. As soon as he was discharged, he was arrested. Another 21-year old man was arrested at the scene of the accident, outlined the reporter.

Police aren’t certain yet as to what happened to cause the first car that the young girl was riding in to go off the road, but they have suspicions that the two cars that were traveling together, were speeding and racing one another. The police are asking for any eye witnesses to come forward and help them with the investigation, explained the source. They particularly want to talk to anyone who saw the blue Corsa before it flipped or a white Ford Fiesta. They’re hoping they can get to the bottom of what caused this fatality. This could very easily be a case of distracted driving on the part of the offending car in the accident. Police in Nassau and Suffolk Counties are on the lookout for distracted driving because this causes the most personal injury in car accident cases.

This is a case wherein the people who are actually involved and got hurt from an accident filed for claims for the injuries that they sustained during the car accident. They also claimed that because of the accident and the injuries they sustained they weren’t able to do their usual daily activities causing disruptions in their regular, productive lives. Distracted driving seems to be the culprit.

According to a police report the case was filed against R&B Car and Limo Corporation and Alexander Laevsky by Mohammad Hossain and Mushfiq Pathan because of an accident that happened on September 10, 2006. The vehicles owned and operated by R&B Limo Corporation and another by Laevsky in which Hossain and Mushfiq were passengers collided with each other. The said collision resulted to injuries in which Hossain complained of pain in his upper and lower spines well as in both of his knees. Mushfiq on the other hand reported to have sustained injuries in his ankle.

According to a witness, doctors Wendy Cohen, M.D. and Julio Westerband, M.D. who were able to examine Hossain and Mushfiq testified that both men were able to have significant normal movements on their spine, knees and ankles after the accident. It was also further established based on the testimony of both victims that they did not miss anytime from their work and school. Hossain was a full time student while Mushfiq worked two different jobs. This further proved that the doctors who examined the victims were correct when they said that the two men both had regular movements on the areas they were complaining of having had injuries.

Road traffic accidents can affect anyone, even when they are doing everything they possibly can to remain safe. Sometimes the road conditions or other drivers expose even the safest of drivers to the risk of car accidents.

A policeman has been given a report caused by poor weather conditions. The driver was driving their children home from their sports game. The weather was very bad and visibility was also poor. The driver has later mentioned that the wind and rain became very heavy while driving along and that she saw the faint outline of a vehicle about to pull out to turn right. She was distracted by the conditions.

The report shows that the driver obviously tried to hit the brakes and stop, but there wasn’t enough time. The wheels locked up and the car went into a spin. This caused it to strike the truck waiting to turn right. This completely damaged the front of both vehicles. There was another vehicle in front which was also involved in the accident.
