New DWI Law Fosters Children – a New York Car Accident Lawyer could be involved

“Leandra’s Law”, a new Child Passenger Protection Act, set to minimize drunk drivers is now in effect. It gives a felony to those who drive while intoxicated or under the influence of alcohol or drugs with children under the age of 16 in their vehicles. The new law denotes that if one is caught driving with a child under 16 years old with a blood alcohol content of .08 or more one may be punishable with an E Class Felony and face up to 4 years in prison; they would also automatically have their license suspended. Courts also have the right to install an ignition interlock system for a period of six months in addition to any imprisonment term. If an intoxicated or impaired driver is caught driving with someone below the age of 16 and also causes someone’s death they may also face a B Class Felony with up to 25 years in prison. If intoxicated or impaired and caught driving with someone under the age of 16 and causes serious hard to an individual they may face up to 15 years and if a parent and or guardian who is charged with driving while impaired or intoxicated while their child is a passenger of the car they will be reported to the statewide central register child abuse and maltreatment.
