Hit and run incident being investigated by police and a New York Car Accident Lawyer

A woman sought by police in connection with a hit-and-run accident in New York that left a former Swampscott woman brain dead is in police custody, but contends that her sister was behind the wheel at the time of the accident, authorities said.

Erinn Phelan, 22, who grew up in Swampscott, was crossing the street with her former college roommate, Alma Guerrero, in Brooklyn’s Prospect Heights neighborhood at around 4:30 a.m. Sunday when the women were struck by an oncoming car. The car sped off without stopping. Police said Phelan attempted to push Guerrero out of the way before impact.

Reports indicate there are no charges for DWIfiled against the driver of the taxi yet. Also, authorities have not said that Drug Possession was an element in this case.

Both women were transported to Kings County Hospital in Brooklyn. Guerrero suffered a broken collarbone, but police said Phelan suffered severe head injuries and was brain dead.

Police found the car, an Acura Legend, abandoned several blocks from the scene. Investigators began to search for Cindy Jasmin, 31, of the Bronx, who was listed as the owner of the car.

A New York City police spokesman, Detective Martin Speechley, said last night that Jasmin met with police at her lawyer’s office yesterday and turned herself in on an unrelated outstanding warrant. He said he did not know what the warrant had been issued for. Speechley said Jasmin was not under arrest on any charge relating to the hit-and-run, and that the crime is still under investigation.

Jasmin told police yesterday, however, that her sister, Frances, was driving the car when it hit Phelan and Guerrero, another police official said.

Phelan was a 2005 graduate of Swampscott High School and went on to attend Brown University. She had moved to New York last summer after getting a job working for Mayor Michael Bloomberg’s new volunteerism initiative, NYC Service.
