This is a case wherein the people who are actually involved and got hurt from an accident filed for claims for the injuries that they sustained during the car accident. They also claimed that because of the accident and the injuries they sustained they weren’t able to do their usual daily activities causing disruptions in their regular, productive lives. Distracted driving seems to be the culprit.

According to a police report the case was filed against R&B Car and Limo Corporation and Alexander Laevsky by Mohammad Hossain and Mushfiq Pathan because of an accident that happened on September 10, 2006. The vehicles owned and operated by R&B Limo Corporation and another by Laevsky in which Hossain and Mushfiq were passengers collided with each other. The said collision resulted to injuries in which Hossain complained of pain in his upper and lower spines well as in both of his knees. Mushfiq on the other hand reported to have sustained injuries in his ankle.

According to a witness, doctors Wendy Cohen, M.D. and Julio Westerband, M.D. who were able to examine Hossain and Mushfiq testified that both men were able to have significant normal movements on their spine, knees and ankles after the accident. It was also further established based on the testimony of both victims that they did not miss anytime from their work and school. Hossain was a full time student while Mushfiq worked two different jobs. This further proved that the doctors who examined the victims were correct when they said that the two men both had regular movements on the areas they were complaining of having had injuries.

However, to prove that they had basis for filing injury claims, Hossain and Mushfiq each submitted affidavits from a chiropractor, Dr. Dennis Long, D.C. which opposed the earlier findings of Dr. Cohen and Dr. Westerband. Dr. Long was able to examine and observe Hossain and Mushfiq a day after the said accident happened. After objective testing, he concluded that both victims had limited movements and motion in their cervical and lumbar spine. He also did a recent examination on both men on March 2010 and found out that even after three years, Hossain and Mushfiq are still having difficulties with their cervical and lumbar spine movements. Based on reports gathered by a friend, the treatments done by Dr. Long had a long gap and treatments were already discontinued because the patients already reached their maximum treatment medical benefit by a chiropractor and physical therapist. Accidents like this one are known to happen frequently in Manhattan and Queens.

Still according to a source, both Laevsky and R&B Limo claimed that their vehicles were at a stop when their vehicles were hit by other vehicles involved in the accident at the rear end. They claimed that because of this circumstance they are not liable to pay any damages as they were also victims of the said accident in September of 2006.

It was established that Hossain and Mushfiq indeed sustained physical injuries and were granted payments for the injuries they sustained during the accidents. Further investigation were done as to who’s vehicle was liable for the said accident.

Car Crash Kills NHL Star

A much liked and local celebrity with a great future ahead of him was killed in a car crash. He was a very young rugby league player who had a bright future.

The 16 year old was killed when he was involved in a car accident on Saturday. He was killed at the scene when he was involved in the accident. It has shocked the whole town of Gunnedah which is normally very quiet.

The NHL Star was traveling along with two friends when he is said to of lost control explained a witness. His car spun off the road and struck a tree. The driver was killed immediately and the passengers required urgent medical treatment because they were seriously injured.

The family of the NHL star are very sad for their loss. They said that the accident has affected the whole community. He was a genuinely nice guy who was liked by everyone who knew him.

Two women passengers were involved in the car crash. These were cut free from the wreckage and transported to hospital where they are said to be in a serious condition.

Two police officers were also involved in an accident where their Patrol Car struck a Toyota in the early hours of the morning. Distracted driving seems to be the culprit.

One of the officers was trapped in the car for over an hour before he could be released by the emergency services. The police then told reporters that he was taken to hospital for cuts and a concussion which needed medical attention.

His injuries are thought to be serious, but not life threatening. He needed to remain in hospital overnight for observation. The other officer was able to get out of the car himself as he was not as badly injured. He only needed some X-rays to check that nothing was broken. Police in the Bronx and Brooklyn are confronted with these situations all the time.

After spending a night in hospital, the police officer was released and allowed to return home. Although the community has lost a much loved sports star as a result of the accidents over the week, at least no more lives were lost.

Woman and Man Seriously Injured by Car Accident

A car accident seriously injured a Woman and a Man who required urgent medical attention. The two victims were said to be in a critical condition and needed hospital treatment, explains a source.

The accident occurred in Pasadena, on Solley Road. The car lost control late on Thursday night and spun off the road at speed. It then hit a large pole in the center of the road which caused serious injuries to both occupants inside the vehicle.

According to the report obtained by the police, both the 42 year old driver, and 24 year old passenger were seriously injured. Eye witness reports report that the car was traveling at excessive speeds along Solley Road. The driver of the car lost control and crossed the center of the road. This caused her to strike a signpost which caused the car and occupants serious injury. First aiders were the first on the scene and offered first aid healthcare.

The impact severely damaged the car which needed to be towed off the road as quickly as possible. The car was towed off the road as soon as the occupants were removed and sent to hospital for treatment. The driver and passenger required inpatient treatment for several days before they were considered stable. They were then released from the hospital and allowed to go home. However, it is thought that both people will suffer from ongoing problems as a direct result of the accident.

The fire service responded and helped to cut the injured people out of the car. The two injured people were transported to the local Shock Trauma Center. Both the man and the woman were said to be in serious condition and were suffering from life threatening injuries. Due to the seriousness of the injuries it was important that both people were removed from the car as quickly and safely as possible.

The local police department is still investigating the case and searching for more evidence. However, the police report suggests that they believe driver error and alcohol were to blame. Police in New York City and Long Island are always on the lookout for drunk drivers. No charges have currently been filed as the investigation is ongoing.

Car, School Bus and Pedestrian Accident

Mere minutes after unloading its last passengers, a school bus was struck by a sedan hard enough that the bus toppled onto its side, claims a witness. The last passengers of the bus, who were neighborhood children, had exited the vehicle within five minutes of the incident.

Police suspect that the driver of the sedan that hit the bus had driven through a stop sign right before colliding with the school bus. The bus, as it toppled over, fell onto a biker that was riding along the sidewalk parallel to the bus. The bicyclist was trapped as the bus smashed her leg and pinned her to the ground. As soon as help arrived and they were able to move the bus off of her leg, the girl was taken by ambulance to the nearest medical center.

The bus driver was forced to exit the school bus by climbing out the driver’s side window. The driver only sustained minor injuries during the car accident.

The sedan, which was completely demolished by the impact and was not considered drivable, contained the driver and his two passengers at the time of the incident. The driver and one of the passengers sustained only minor injuries while the second passenger was sent by ambulance to receive medical care, states a hospital report.

The police spent several hours recording the placement of vehicles and other evidence from the scene of the car accident. It was late evening before the roads and sidewalk in the area was reopened for the public.

Though the police are investigating the circumstances which led to the crash, they have yet to determine the exact series of events that led to the accident. They have issued a request for any witnesses to come forward to shed light on the matter. An Accident like this could have happened anywhere. If school children and buses are on the road in The Bronx and Brooklyn care must be taken.

Charges have not yet been filed against the driver of the sedan, due to a lack of evidence and witnesses, although the circumstantial evidence may be enough to press charges. The case is further complicated by the fact that the driver of the sedan was not a United States citizen, explains a spokesperson.

Four Students Dead After Car Accident

Several young people were killed in a car accident last weekend when their vehicle crossed into oncoming traffic. Their car was then struck by an oncoming truck which resulted in the death of four passengers and severe injuries to the driver of the vehicle, explains a witness. The accident occurred only days after two of the passengers had finished their graduate degrees and were planning on returning home.

The accident occurred late Saturday evening after the group of students was out celebrating the end of the school year. The driver of the vehicle, the sole survivor amongst the group of students, was in critical condition and under the care of medical professionals at the time of this article.

Police had not yet released any information as to what cause the driver to swerve across the center line. Possible causes include alcohol or distraction by one of the passengers. The police will have more information as the driver recovers and recounts the events of the evening, states a source with the police department..

The driver of the other vehicle and his passenger survived the accident with relatively minor injuries. He is not being blamed for incident and, by all accounts, tried to avoid the collision. Luckily the other drivers on the road were able to avoid turning the collision into a multiple car accident.

Meanwhile, the students families are gathering at the school to mourn their losses and support the driver as he recovers, a fiend of the family explained. Since classes have already let out for the semester, the school has not yet set a date or made plans for a memorial service. The students’ families will make the arrangements for each student’s burial.

At this point, no charges have been filed against either driver or the passengers in the vehicle. As further details revealed, it is possible that charges of negligence could be filed against the driver. A full police report was unavailable at this time. The college could not be reached for comment although several students offered words of support and encouragement for the injured driver.

Nassau and Suffolk Counties have implemented strict laws and harsh punishment for drunk driving. This is due to the terrible accidents and deaths which have plagued these Long Island communities. MADD has had a great influence in this part of the world.

Bicyclist is in Critical Condition

A bicyclist is in critical condition after being struck by a car which was violating traffic laws last weekend. The biker was following all relevant traffic rules when the motorist struck him with his vehicle after running a red light. The driver of the vehicle has been charged in the case and is currently in police custody.

The driver of the vehicle was under the influence of prescription medication and should not have been operating the vehicle; police have not released what medication the man was on at the time of the accident. He also has a history of traffic violations, explains a report. The majority of his prior incidents were speeding tickets, although driver of the vehicle had ticket a bicyclist approximately 13 years ago.

The first time the man hit a bicyclist, the bicyclist escaped with very few injuries. In this current incident the bicyclist has life threatening injuries and continues to be hospitalized as he attempts to recover from the life threatening injuries.

The man is facing several charges including driving while under the influence and criminal negligence. The charges could be increased to include homicide charges if the bicyclist dies because of his injuries. Exact charges will not be known until the extent and outcome of the bicyclist’s injuries are known.

The driver is eligible for bond although he has not posted bond at the time of this article. Based on his large number of passed traffic incidents, he will have a difficult trial ahead of him if the case is not settled out of court. The driver will assuredly be found liable for the bicyclist’s injuries, medical bills and pain and suffering, reports a source.

The bicyclist was not wearing a helmet at the time of the accident; the lack of helmet undoubtedly caused his injuries to be worse than if he had been wearing a helmet. The local police have used the incident to issue renewed statements emphasizing the importance of bicycling safety, says a source. Groups which promote bicycling statements have echoed the police’s message that bikes and automobiles need to share the road. Car accidents like this one are common in areas like Staten Island and Westchester.

Two Car Accident Kills two People

Two men were killed in a car crash which happened at around 10 PM at night explains a report. The accident happened on Thursday and two cars were involved.

A 22 year old male was driving a Ford Mustang along west smith road in a westbound direction. A 46 year old man was driving in the opposite direction along the same road in a Dodge Charger. This driver crossed the center line which caused a head on collision which was very serious.

The first younger driver was taken to Medina Hospital. However, by the time he arrived at hospital he was pronounced dead explains the doctor. His family were told of the accident and asked to identify the body.

The other driver was flown directly to a hospital in Cleveland. He was also declared dead on arrival as a result of his injuries. The emergency services did absolutely everything that they could to take care of the drivers, it is just a shame that they died on the way to hospital.

There was an 18 year old passenger who was also flown to a hospital. She is thought to be in serious, but stable condition and still undergoing medical treatment for her injuries which are not life threatening explains the expert.

The Police Departments investigation states that the roads were fairly wet and this is thought to of been a contributing factor to the crash. Blood tests of both drivers were taken and it is not thought that any alcohol was involved.

Nobody has been charged over the car accident although the investigation is still ongoing. It is not expected that anyone will be charged for this as both drivers died at the scene. The investigation suspects that the car accident was caused by the older driver crossing the line due to wet road conditions. Accidents like these are common in Queens and also Staten Island.

It's good news that any other cars traveling on the road at the same time were able to stop in time to prevent a pileup. If more cars were involved then the injuries could have been even more serious.

Traffic Accidents Over the Weekend Kill Three People

A number of car accidents happened over the weekend in West Virginia. Three people died as a direct result of these accidents. Fatal accidents are very serious and need to be investigated thoroughly by the police department.

One man died on Sunday evening after he lost control of his car and it spun off the road. The car crashed into a tree which killed him instantly. Two passengers in the vehicle were rescued from the car and airlifted to a hospital in Virginia.

State police Troopers were some of the first to arrive on the scene state the report. The cars were badly damaged which meant many people were trapped inside.

Some family members of the people involved in the crash arrived shortly after the accident to help search for survivors. This was very emotional as at least one family member collapsed when he learned of the death.

Another crash claimed the life of a 20 year old woman on Saturday. This was caused by a serious ATV accident which was in Fayette County.

Crash investigators handed their report to a chief who said that she lost control of her vehicle while traveling along Hopewell Road. She lost control while traveling around a very sharp bend. Because she was not wearing the seat belt she was thrown from the vehicle and was not found for two hours.

The third death of the weekend happened in an accident during the early hours of Saturday morning. This claimed the life of a 22 year old man who was traveling on Route 39. He also lost control of his vehicle. The car flipped over a number of times as a result of it spinning out of control. The driver of the car was thrown from the vehicle and was instantly killed before medical assistance could be given. Studies in New York City and Westchester County have determined that distracted driving causes many of these accidents.

Fortunately these car accidents were no worse than they were. If they happened at any other time of the day then they could have been much more serious and involved many more vehicles which could of caused more people to lose their lives. It's fortunate that the passengers of all vehicles escaped only requiring medical treatment.

Motorcycle fatalities recall other serious accidents on Route 110

A motorcyclist was seriously injured after being involved in a road traffic car accident. The motorcyclist was going for a short ride along route 110.

The motorcyclist was so badly injured that she suffered from short term memory loss. She cannot remember anything that happened on the lead up to the accident. Her memory for the whole month has actually been affected.

According to a report read by a reporter, a witnesses saw the car accident as it happened. Another driver in a car was trying to make a U turn in the road, where it is not permitted. The motorcyclist was traveling at 40 miles per hour, which was well within the speed limit of the area. This means that she had no chance of stopping in time because by the time the car was seen, it was already too late.

The motorcyclist attempted to stop as quickly as possible. This caused her bike to skid and the rider was thrown over the top of the bike. She landed on her head on the road.

The motorcyclist was not wearing a helmet and the observer states that if a helmet was worn, that the injuries would have been much less serious. Because no helmet was worn the rider suffered from extensive brain trauma which caused her to go into a coma for over a week. The head injuries also resulted in memory loss.

The New York Accident Attorney has a copy of a report demonstrating the severity of the injuries sustained. She suffered from facial injuries which required many hours of reconstructive surgery to put right. Her left wrist was shattered and jaw fractured.

The injuries were so serious that it was thought unlikely that the rider would make a full recovery. She was taken straight to Bridgeport hospital. A similar accident a few weeks after this accident resulted in fatality with the motorcyclist and passenger being killed in similar circumstances.

The police investigation into the crash which calmed the lives of two men is still ongoing. Route 110 is a notoriously dangerous place to ride a motorbike with there being many accidents. While some of these accidents are caused by excessive speed or driving under the influence, some of these accidents happen through no fault of the drivers themselves. The high volume of traffic is thought to be one of the main reasons why there are so many accidents involving motorcyclists.

The motorcyclist has since made a full recovery but vows never to get on a bike again. Accidents like this can happen anywhere. Even in urban areas like Manhattan and Queens.

Two Dead After Head On Collision

Earlier this week, two people, a man and a woman, were killed in a head on collision as the woman moved into oncoming traffic. The two vehicles, both pickup trucks, were totaled as they smashed into each other. The man’s truck, at the time of the car accident, was a horse trailer which was also damaged in the collision.

The woman driving her pickup truck was at fault in the in accident; she was breaking the posted no passing signs in an attempt to pass a third vehicle which was on the road. In an attempt to pass the other vehicle quickly, the woman driver was traveling at dangerously high speeds, reports a witness. As she moved into oncoming traffic to attempt to pass, the two pickup trucks collided head on.

It is unknown exactly what speed the vehicles were traveling at the time of the incident. However, based on the damage to the two vehicles, the woman’s speed was dangerously high. At this point, there is no suspicion of drugs or alcohol being involved.

While we may never know what caused the woman to make this risky move, it is even more surprising in light of the fact that there was a toddler in the vehicle at the time. The report noted that the child survived the collision with only minor injuries. There was also a horse in the horse trailer at the time; the horse managed to escape the event uninjured.

Because of the narrow road where the accident occurred, it look police crews a long time to clear the accident and the road was shut down for several hours as emergencies crews removed the vehicles and the people involved.

Because there is little question that the woman who died was at fault in the accident, there will not be charges filed. Assuming that both drivers were properly insured, the insurance companies in The Bronx and Brooklyn will determine the liability and monetary compensation to each of the deceased estates. Services were planned for each of the drivers, but further details were not available at this point.
